GENERAL TERMS AND CONDITIONS OF SALE AND DELIVERY (as of January 1, 2024)

 § 1 General.

These General Terms and Conditions of Sale and Delivery constitute the exclusive basis for all contracts between Bonsai & Wein, legally represented by Mr. Marius Klein, Kunohof 20, 54439 Saarburg , and its customers regarding orders for goods. 

§ 2 Storage of contract texts and minimum order quantity.

The customer can save the contract text, i.e., the complete contract details, on the website at www.vinothek-der-saar.de by clicking the "Download" button in the form in their browser. The contract text can be printed by clicking the "Print" button in the form in their browser. The contract text is saved by the provider and can be sent to the customer by email free of charge at any time upon request.

There is no minimum order quantity required. Prices valid at the time of order apply. The prices listed in the price list include glass, equipment, sparkling wine and VAT, and license fees for the use of the "Der Grüne Punkt" trademark. Deliveries are subject to availability.

§ 3 Shipping and packaging.

Packaging is provided in shipping boxes. Domestic shipping is at the seller's risk. The flat rate shipping fee, including transport insurance, for deliveries within Germany is €6.90 per shipment. Delivery is free for orders over €120.00. For deliveries abroad, freight charges are calculated according to the country of destination. 

§ 4 Payment and prices.

All prices in price lists and in the online shop are gross prices including VAT.

Payment is made in advance to the account specified on the invoice. PayPal, Klarna, and various credit cards are available as payment options. After receipt of payment, delivery will be made to the recipient's address.

The customer only has a right of set-off if his counterclaims have been legally established, are undisputed or have been acknowledged by the provider. 

§ 5 Reservation.

Should the ordered goods not be delivered on time or at all despite the prior conclusion of a corresponding purchase agreement between the provider and its suppliers, the customer will be informed immediately by the provider. In such a case of delayed delivery, the customer is free to wait for the ordered goods, cancel the order, or withdraw from the contract. If delivery is impossible, both parties are entitled to withdraw from the contract. In this case, any payments already made will be refunded immediately. If wines or sparkling wines are sold out, the customer can also request the provider to deliver a subsequent vintage of equivalent value instead.

§ 6 Delivery. Transfer of Risk. Retention of Title.

The goods will be delivered to the delivery address specified by the customer. Delivery of the goods is at the provider's risk. The risk of accidental loss and accidental deterioration of the goods passes to the customer upon delivery to the customer.

The goods remain the property of the seller until the purchase price has been paid in full.

Should the ordered goods not be available on time or at all despite the prior conclusion of a corresponding purchase contract with the provider, the provider will inform the customer immediately. In such a case, if delivery is delayed, the customer is free to wait for the ordered goods or withdraw from the contract. If delivery is impossible, both parties are entitled to withdraw from the contract. In the event of withdrawal, any consideration already provided will be immediately reimbursed to the customer. Should such sparkling wines, which are produced in limited editions, be sold out, the customer can also request the provider to deliver a subsequent vintage of equivalent value instead.

The provider is entitled to make partial deliveries, provided this is reasonable for the customer. If partial delivery is made at the provider's request, no additional shipping costs will be incurred. Additional shipping costs will only be charged if the partial delivery is made at the customer's express request. 

§ 7 Customer rights in the event of defects.

The customer's rights to subsequent performance, withdrawal from the contract, or reduction of the purchase price in the event of defects are governed by statutory provisions. Any claims for damages in addition to or in lieu of performance are governed by Section 8. Please address any complaints to:

§ 8 Liability.

The provider shall not be liable for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations or guarantees or give rise to damages resulting from injury to life, body or health or claims under the Product Liability Act.

To the extent that the provider’s liability is excluded or limited, this also applies to the liability of the provider’s legal representatives, employees and vicarious agents.

The provider is not liable for the functionality of data networks, servers or data lines to its data center and the constant availability of its online shop.

§ 9 Data protection.

The personal data voluntarily provided by the customer as part of his order will be used exclusively in compliance with the provisions of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).

The customer's personal data will only be collected if and to the extent that the customer voluntarily provides such data to the provider. This data will only be processed and shared with third parties to the extent necessary to fulfill the contractual relationship between the provider and the customer. Therefore, the data will be shared with the shipping company commissioned with the delivery. Data will not be shared with third parties beyond this point.

The customer has the right to obtain information about his stored personal data free of charge at any time, as well as the right to correct, block or delete this data.

The content of the data protection information within the meaning of this clause is available to the customer at any time at www.vinothek-saar.de.

Questions regarding the collection, processing or use of personal customer data, information, corrections, blocking or deletion of data as well as the revocation of consent granted can be addressed to the provider at the address stated in Section 1 Paragraph 1 of these General Terms and Conditions of Sale and Delivery.

§ 10 Miscellaneous.

In accordance with the Youth Protection Act, the provider does not deliver alcohol to minors under the age of 18.
